Rana Rizwan Hussain (Comparative and International Dispute Resolution LLM, 2011) is a practising lawyer based in Lahore, Pakistan, and the Founding Partner at Hussain and Associates (Advocates & Legal Consultants). He completed his LLM in Comparative and International Dispute Resolution from Queen Mary, University of London, in 2011. His LLM dissertation was supervised by prof. Loukas Mistelis which was subsequently published in Asian International Arbitration Journal, Volume 9, Issue 1. Rizwan’s focus in legal practice is commercial litigation and arbitration besides resolving disputes through Alternative Dispute Resolution (ADR). He regularly lectures in the areas of Alternative Dispute Resolution, International Arbitration and Commercial Law at recognized institutions in Pakistan. He has delivered guest lectures at different professional training organizations including Lahore Bar Association and Management and Professional Development Department of Government of Punjab. Rizwan has published various articles in different areas of law in local and foreign journals and is a contributing author of the World Arbitration Reporter (JURIS Publishing) wherein he has contributed a chapter on the law of arbitration in Pakistan. He has also published several articles on social, legal, and academic topics in newspapers and magazines in Pakistan and keeps many published book reviews to his credit.
Most recently Rizwan has published the second edition of his book ‘International and Domestic Arbitration in Pakistan: Law and Practice. Rizwan says about his publications: “The first edition of the book was published in 2018 which was greatly admired by the legal fraternity including the judges of the Provincial High Courts as well as the Supreme Court. The book discusses the law and practice of arbitration in Pakistan that has developed over the years. Starting with an overview of arbitration practice in Pakistan, it talks about the different stages of it i.e., pre-arbitral stage, arbitration procedure, and post-arbitral stage. The discussion entailed in the book is mainly based on the statutory provisions and the case law. Moreover, scholarly opinions have been added to furnish off the gaps. It comprehends the domestic and the international arbitration practice in Pakistan.
After defining arbitration and discussing its nature, it provides an overview of arbitration in Pakistan and analyses the pre-arbitral stage. Thereafter, it moves to the arbitration procedure and illuminates the modus operandi of domestic and international arbitrations. It also brings into study the relationship between the arbitral tribunal and the court, both in international and domestic contexts. It defines the role of a national court in international arbitration proceedings. Thereafter, it explains the validity of different types of awards and enumerates the post-award stages. It also talks about the after-award proceedings including enforcement, appeal, and annulment actions. In this regard, this book comprehensively discusses the domestic and foreign awards, further distinguishing between foreign commercial and investment awards. The book consists of thirteen chapters and each one of them contains a comprehensive and conducive to understanding discussion on its respective area.
