CCLS Alumnus recently published an article: Which Kind of Individuals Can be Debtors under Peruvian Bankruptcy Law.
José Carlos Rodríguez-Montoya Carranza (Laws LLM, 2023) recently published an article in the quarterly journal of International Association of Restructuring, Insolvency & Bankruptcy Professionals (INSOL) International (2nd quarter 2024). In this article called "Which kind of individuals can be debtors under Peruvian bankruptcy law?", he briefly states a recent experience before the Insolvency Commission of INDECOPI, where the interpretation of the definition of "economic activities" under the Insolvency Act was restrictive, diverging from both the letter of the law and the economic reality of the country. As outlined in the article, this isolated decision could have several impacts on the market.
