The investor-State dispute settlement system is undergoing unparalleled transformation in the face of calls for the greater regulatory freedom for States. Debates over an investment court in lieu of arbitration also continue apace in various fora, including UNCITRAL Working Group III. So what will be the fate of investor-State arbitration 25-years from now? Will it fundamentally change into a different mechanism or will it evolve to still retain elements of the system we see today? Will it adapt to meet the changing needs of global business, or face extinction in the face of growing criticism?
