The thesis will analyse the doctrinal contract law distinction between the Spanish and UK common law systems in the context of data protection contracts, which emerge from commercial agreements. This research will explore whether it is possible to arrive at contractual language symmetry under the Data Protection Directive and GDPR for key terms in data protection contracts and commercial agreements. This concern is particularly relevant for cloud providers considering their cross-system provision, processors’ new direct obligations and the imprecise boundaries of the controller/processor relationships.
