Giving evidence to the EU Justice sub-committee on Tuesday, Queen Mary Professor Valsamis Mitsilegas said that no matter the type of dispute resolution alternative the UK will choose to implement post-Brexit, there will still be no escape from rulings of the European Court of Justice. Professor Mitsilegas said: “The European Court of Justice will remain relevant, whether we want it or not if the UK has a relationship with the EU. For example, if there is an issue with a security treaty and the European arrest warrant continues in some shape or form, and there is, for example, a European arrest warrant issued by a British authority to a French authority and it is going to be executed under this agreement, nothing stops the French judge to send a preliminary reference to the European Court of Justice on the compatibility of this request with EU law.” Professor Mitsilegas' evidence was featured in The Express.
