Conflicts between Trade Secret Protection and Algorithmic Transparency in Automated Decision-Making ---A Comparative Study of China, EU, and US Law

Summary of Research

Automated decision-making develops rapidly and is widely applied in the public and private sectors. Plenty of companies now adopt the trade secrets approach to protect automated decision-making. However, the trade secrets protection for automated decision-making will deepen the negative impact of societal challenges. Meanwhile, algorithmic transparency is strongly called for in the legal dimension. Therefore, severe conflicts exist between trade secrets protection for automated decision-making and algorithmic transparency. This thesis considers the conflicts between trade secret protection and algorithmic transparency in automated decision-making, aiming to propose a regulatory model to balance these conflicts in the Chinese jurisdiction.

Biography

Jiahui Chen obtained a Bachelor of Laws degree with Distinction from Guangdong University of Foreign Studies and a Master of Laws degree from Jinan University. She passed the National Unified Legal Professional Qualification Examination in China. She started her research journey at Queen Mary University of London in 2022. She is a PhD candidate with research interests in intellectual property law, competition law, and artificial intelligence.
