The international paradigm of discrimination by nationality in tourist and short stay visas

Summary of research

This PhD project will critically address the mechanisms used worldwide to control human mobility, using the theory of equality and non-discrimination as a conceptual framework. This will be done through the comparative evaluation of three possible border entry scenarios: free movement, the presentation of a passport proving identity and the requirement of a tourist visa. 

This research aims to determine the use of tourist and short-stay visas as the globally used mechanism of illegal immigration control from legal and sociological theory, comparing three cases from three continents over a period of 30 years. In order to respond to this objective, I will try to clarify the existence, conscious or unconscious, of an internationally accepted paradigm of discrimination on the basis of nationality in requiring and obtaining these visas.

Biography

Nicolás Rodríguez is a PhD candidate in Law from Queen Mary. He completed his LLM mention in Constitutional Law at the P. Universidad Católica de Chile, where his thesis was entitled ‘The chilean discriminatory migratory hierarchy’, and obtained his law degree from the Universidad del Desarrollo.

Nicolás has research experience in the areas of Constitutional, Regulatory, Migration Law and Human Rights. His research interests are related to migration and the theory of equality and non-discrimination.

He is currently a Teaching Assistant on Public Law at Queen Mary. He also has experience as a professor in Political, Constitutional and International Public Law in Chile, and has worked as a legislative advisor in the Ministry of Public Works and for the National Congress of Chile through NGOs and Think Tanks. 

Nicolás' research is funded by the Queen Mary - GTA Programme. He has been elected as the PhD Student Representative 2024-25 of the Faculty of Law.
