The Centre for European and International Legal Affairs (CEILA) Key Notes in EU and International Law
The CEILA Key Notes series is intended for early academics and more established scholars undertaking cutting-edge research in EU and international law (as well as their interaction) to share their thoughts and spark debate, engaging in a discussion with colleagues and a wider audience.
Mr Horia Ciurtin (Scandic Distilleries SA) and Ms Emanuela Matei (CELS and Mircea & Partners, Bucharest) 'Turning Enemies into Adversaries: TTIP Negotiations and the Quest for a New Westphalia Momentum'.
Neither universalism, nor isolationism can be regarded as legitimate representations of a pluralist global society. Evidence can be brought that in economic terms the current paradigm engenders instability by enhancing inequality within and among diverse constituencies. The present-day factual reality denies the zero-sum game pattern and, together with that, the reliability of the Westphalian model. What type of legal processes should be used in order to ensure investor protection for the purpose of concluding free trade agreements between the EU and a sovereign of equal calibre? With this question in mind and against the factual reality of an enlarged EU and other altered economic contingencies, we engaged in the study of a number of relevant disputes on investor protection obligations and state aid control.

Ms Emanuela Matei is a Research Associate of CELS and Of Counsel of Mircea & Partners, a law firm with headquarters in Bucharest, Romania. After eight years of professional career in investment banking she decided to shift back to academic studies and legal research. Areas of specific interest for her are global antitrust, trade and tax laws. She received her MBA (Civilekonom) and Juris master from the Lund University, Sweden. Ms. Matei is a permanent contributor of Kluwer International Tax and C.H. Beck’s Tax Journal and recurrent contributor to other publications such as the ABA Journals and the GCLR Review.
Mr Horia Ciurtin is legal adviser in the field of international arbitration and investment law for Scandic Distilleries S.A. (Romania), Managing Editor of the EFILA Blog under the auspices of EFILA (Brussels), as well as editor at VERSO Journal (Bucharest and Cluj-Napoca, Romania), one of the leading cultural journals from Romania. He has a Master of Laws in European and National Business Law from Babes-Bolyai University, Cluj-Napoca, Romania, as valedictorian. He is the author of the constitutional law and legal philosophy volume The Dilemmas of Constitutional Review: Inquiry in the Euro-American Paradigms [original title: "Dilemele controlului de constitutionalitate: Incursiune în paradigmele spatiului euro-american"] (Bucharest: Rosetti International, 2013). In 2014, he was awarded the Honorable Mention in the Nappert Prize in International Arbitration and International Commercial Law (organized by McGill University).
